Daily/half-day rental

Rent our bikes for as many days as you need to discover this sport, test the product or for convenience.

These general rental conditions, hereinafter referred to as "GC", define the conditions under which customers can hire the rental service offered by Cinca Riders, S.C.

By contracting the rental service, the Client acknowledges that he/she has read and fully accepts, without reservation, the terms and conditions of the service stipulated in this document. These general conditions prevail over any other general or specific conditions not expressly approved by Cinca Riders, S.C.

2.- Introduction

These general rental conditions (hereinafter "the Conditions") shall apply between Cinca Riders, S.C. whose object is the rental of all kinds of goods for use and consumption of a sporting nature and is the owner of the item covered by this contract and the Client (hereinafter "the Client") who acts in his own name and representation and declares under his strict responsibility, that he has reached the age of majority (18 years) and has full capacity to act.

The parties agree that their relations shall be governed exclusively by these Conditions, which are accessible on the website https://www.cincariders.com/, and must, in any case, be previously accepted by the Client.

In the event of modification of these by Cinca Riders, S.C., the conditions to be applied to each Client will always be those accepted at the time of contracting.

The Customer, prior to contracting and in any case in the payment process, may access, file and print these conditions for consultation. These Conditions will be available in Spanish.

3.- Description of the service

The Service offered by Cinca Riders, S.C. is a rental service consisting of the following:

Cinca Riders, S.C. offers its customers a rental service for days or half days so that you can live new sporting experiences. To enjoy our rental service, we put at your disposal our website https://www.cincariders.com/, where you can check the available offer, the availability of stock for the selected dates, as well as pay your rental reservation.

During the booking process, you will have to select the products you want to rent, as well as the date you would like to hire the service, the delivery time and the location, and then add the rental products to your basket. To complete your rental booking, you must follow the steps on our website and finally proceed to payment by entering your credit card details.

Once the payment is completed, you will receive a confirmation email. From this moment on your rental booking will be available on the dates indicated in the email.

At the same time, you can also make your rental booking by telephone, WhatsApp or social networks.

To do this you must contact Cinca Riders, S.C. by any of the above means and with the help of one of our agents you will be able to manage the rental booking.

During the process, the agent will ask you for information about the route you wish to take, physical condition, ability on the bicycles, duration of the rental and contact and billing details.

Once all this information has been completed, we will be ready to proceed with the payment.

Payment can be made at the time of delivery of the material, but a prior reservation will be made digitally: for this you must have a credit or debit card, visa or mastercard. Payment can also be made via Bizum.

Once the payment is completed, you will receive a confirmation email.

From this moment your rental reservation will be available on the dates indicated in the email, and the agent will proceed to deliver your reservation so that you can enjoy the rental.

4.- Condition and use

Cinca Riders, S.C. rents to the Client the sports equipment which is the object of this contract and which is, as acknowledged by the Client - after having examined it - in perfect condition.

The rented sports equipment is intended solely and exclusively for leisure sports, and may only be used by the customer or by minors of whom he/she is the guardian in the event that the product is intended for the use and enjoyment of said minor, under the absolute responsibility of the same.

Consequently, the total or partial sub-letting of the same for any other purpose is strictly prohibited, as well as the use of the same by third parties not participating in the rental contract.

Furthermore, the sporting goods may not be used for any activity other than the aforementioned, under penalty of automatic cancellation at the initiative of Cinca Riders, S.C., without prejudice to the corresponding compensation for damages caused.

The use of the product is strictly forbidden in the following cases:
- Circulation through watercourses, rivers, ravines or other water currents that are deeper than 25cm. The bicycles are electric and are not 100% watertight, which may cause damage to the electrical parts.
- Riding in adverse weather conditions, classified as orange and red warnings by the State Meteorological Agency.
- If during the use of the product there has been any damage that causes a malfunction, unusual noise or loss of any of its characteristics such as failure of the gears, loss of oil from the forks or shock absorber, excessive noise from the brakes, failure of the electrical system, etc.

Finally, the sporting goods may not be taken abroad without prior written authorisation from Cinca Riders, S.C., and in such a case, before going abroad, the Client must take out insurance for this purpose at their own expense.

5.- Characteristics of the product and delivery

Before contracting the Service and in accordance with Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, the Customer may obtain information from Cinca Riders, S.C. on the technical characteristics and conditions of each product that he/she wishes to rent.

The Client is free to choose the sports product that he/she wishes to rent and acknowledges having been informed of the technical specifications and condition of the same prior to the rental.

The Customer declares that the said product is suitable for their use according to their height, weight and sporting level.

Therefore, Cinca Riders, S.C. accepts no responsibility for the inadequacy of the products for the Client's needs and is therefore exempt from all liability for any mishaps that may occur as a result of the use of the same.

Cinca Riders, S.C. always recommends the use of the necessary safety elements for the safe use of the product.

The Client is free to take out an insurance policy or not for this purpose both for the coverage of their own civil liability and for the coverage of possible bodily accidents arising from the practice of sport, although Cinca Riders, S.C. recommends this as the practice of sport always involves a risk.

6.- Payment conditions and payment procedure.

6.1 Terms of payment

Payment will be made online (card) through the payment gateway within our website https://www.cincariders.com/. This payment will consist of a single instalment to be paid at the time of booking depending on the days selected. In the event that the client wishes the delivery of the material in a location other than El Grado (Huesca), Cinca Riders, S.C. will apply the transport charges derived from the same.

To proceed to the payment the Client will be able to choose between two options:

The customer must access our website, select the items you want to rent, the dates on which you want to rent our products and the place of delivery / collection of the same. Finally, at the last step, you must enter your bank card details to proceed with the payment of the rental of your product/s.
During this process, the customer must accept the General Terms and Conditions of the daily rental, as well as the Privacy Policy.

In order to offer a secure payment to the customer and to prevent fraud as much as possible, we have selected the 3D Secure authentication system for Visa and Mastercard.

Therefore, your payments will be completely secure.

During the payment process, the client will pay the total amount corresponding to the rental days that he has contracted. The amounts derived from the possible transfer of the material according to the established price table will remain pending for the moment of delivery.

Generate your rental reservation by telematic means:
With the help of one of our collaborating agents, a rental reservation will be created for you, which you can pay by bank card and dataphone or web link.

Once the payment has been made, the customer can leave the shop with the rented product.

6.2 Payment procedure

6.2.1 Identification of the Customer

The rental of the service is conditional upon presentation of an identity document (national identity card, valid residence permit or passport or driving licence or valid residence permit) for verification at our offices in order to check the identity of the signatory of the contract.

6.2.2.1 Accepted bank cards

Only Visa and Mastercard credit cards are accepted. Any other means of payment will be refused. The Customer undertakes to be the holder of the bank card and/or to be entitled to use it for the purposes of this order.

6.2.2.2 Payment

The Customer is informed and expressly accepts that the validation of his bank details is carried out via our website through the secure platform of the payment service provider Shopify Payments.

Payment for the rental service is charged to the payment card provided by the Customer at the time of hiring.

All invoices from the Client will be sent by e-mail to the indicated account.

6.3 Validation of the Contract and commencement of the rental period

The service starts as soon as the Client has accepted and validated the general terms and conditions and has made the payment.

7.- Duration and termination

The duration of the rental will be that indicated on the website, which may be by the hour or by the day depending on each product, without a maximum period of time (the customer will choose the period he/she considers and will pay through the website).

The period will start from the day on which the Customer has taken possession of the rented sporting goods during which he/she will have the right to freely terminate the contract at any time and without any penalty before the start of the rental period.

To make this possible, he/she will have to contact Cinca Riders, S.C.

The cancellation will be effective when the client receives confirmation of the cancellation of the rental by Cinca Riders, S.C.

If the client wishes to cancel the same day on which he/she has taken possession of the rented sports equipment, once the rental period has begun, he/she may do so, but a penalty will be applied, corresponding to the price of 1 day's rental.

8.- Return of the sports equipment and responsibility of the client for non-compliance.

Once the contract has ended, the Client shall be obliged to return to Cinca Riders, S.C., at the place where it was rented, the sports item which is the object of this contract, in the same state of conservation in which it was found when it was delivered, with only the deterioration of wear components (tyres and brake pads) being accepted, always making a logical use of the same in accordance with the sporting activity in leisure mode.

The Client is responsible for the safekeeping of the sports article from the moment of its delivery, until its return to Cinca Riders, S.C.

When the product is returned to our offices, it will be inspected in the presence of the Client.

In the event that the customer returns the rented sports equipment outside the periods indicated on the invoice, he/she shall pay compensation for each day/hour of delay in returning the goods, equal to the daily rental rate (extra day), and without prejudice to the greater damages caused to Cinca Riders, S.C.

In the event that the Client does not return the broken or partially broken material or part of it, the Client shall pay compensation equivalent to the selling price (RRP) of the broken or partially broken material as indicated in the list of components. The customer shall pay the price of the product including VAT at our offices.

In the event of theft or robbery, the Customer must report it to the competent authorities and immediately notify Cinca Riders, S.C. in writing.

The Client is liable in the event of damage, theft/robbery or loss of the sporting goods, whatever the reason and/or cause, and therefore undertakes to pay Cinca Riders, S.C. the amount corresponding to the sale price including VAT of the said sporting goods.

9.- Liability for damages

The Client shall be personally liable for damages caused to the rented sports equipment by the use thereof, unless he proves that they have been caused through no fault of his own.

The Customer is liable for damages caused to third parties and/or himself/herself due to improper use or non-compliance with the relevant regulations.

The Customer shall be solely responsible for knowing and complying with the traffic, navigation or similar regulations applicable in each of the locations where the product is enjoyed or used.

The Client is liable in the event of damage, theft or loss of the sports item, whatever the reason and/or cause, and therefore undertakes to pay the Client the amount corresponding to the sale price of the said sports item.

In the event of theft or robbery, the Client must report it to the competent authorities and immediately notify Cinca Riders, S.C. in writing.

10.- Deposit

For all rentals, Cinca Riders, S.C. will ask the Client for their credit or debit card details as a deposit.

Cinca Riders, S.C. will only use these details for the collection of the broken or partially broken material as indicated in the previous point, having a period of up to 3 working days to do so.

Cinca Riders, S.C. will ask the Client for an amount in concept of financing in the following cases:
- Adverse weather conditions for the days covered by the rental or on previous days (maximum of 10). Weather warnings from the State Meteorological Agency will be consulted.
- Transport of the material by own means. If the material is transported in the client's own vehicle, either in the vehicle itself or in bicycle racks.
- Area where the risk of material breakage is high. This will be based on the average difficulty of the route or area to be undertaken, as typified in the ZTrails or Trailforks applications.

11.- Ownership of the product

Throughout the rental period, the product shall remain the exclusive property of Cinca Riders, S.C. The Client may not claim ownership and may not dispose of the product (sell it, sublet it for free or for a consideration, etc.) without the prior written authorisation of Cinca Riders, S.C.

12.- Obligations of Cinca Riders, S.C.

Cinca Riders, S.C. undertakes to provide the Customer with a product in good working order and which corresponds to the characteristics precisely described in the signage on the website.

Cinca Riders, S.C. has a general safety obligation for the products it markets.

13.- Responsibilities of Cinca Riders, S.C.

13.1. Cinca Riders, S.C. reserves the right to temporarily interrupt access to the service and/or the website for maintenance purposes.

Likewise, Cinca Riders, S.C. shall not be held responsible for any difficulties or temporary impossibility of accessing the site for reasons beyond its control, force majeure or disturbances in the telecommunications networks.

13.2. Cinca Riders, S.C. does not offer the Customer any guarantee as to the suitability of the products for its needs, expectations or limitations.

13.3. Cinca Riders, S.C. shall not be liable for the non-execution or delay in the execution of the service due to circumstances, difficulties or temporary impossibility of access to the website or the delivery offices caused by circumstances beyond its control due to disturbances in the telecommunications networks or force majeure as provided for in article 1105 of the Spanish Civil Code, to which must be added in particular in the event of an attack, health crisis or any legal or regulatory obligation or public order imposed by the competent authorities which has the effect of substantially modifying these General Terms and Conditions.

13.4 In any case, the liability that Cinca Riders, S.C. may incur by virtue of the present conditions is expressly limited to the direct damage suffered by the Client.

14.- Intellectual property

Cinca Riders, S.C. retains all intellectual property rights relating to its products. The service does not imply in any case the concession of a right on the brand or on these rights.

The Customer may not make any modification to the product, including the product itself, its instructions or any element accompanying the product.

15.- Obligations of the Client

The product and its accessories are the exclusive property of Cinca Riders, S.C. They are considered to be in good working order at the time they are made available.

15.1 Safety

The Client undertakes to take out civil liability insurance to cover the use of the product by the user during the rental period and any damage caused to third parties or their property.

The Client undertakes to use the Product with due care and to maintain it in accordance with the advice, instructions and/or manuals provided when collecting the Product.

15.2 Custody of the Product and prohibition of subleasing

The Customer rents the Product for normal use.

In the event of abnormal use/wear of the Product, Cinca Riders, S.C. reserves the right to terminate the service and to claim any compensation for damages.

The Client is prohibited from lending or subletting the product, especially in the context of a professional activity.

16.- Protection of personal data

In compliance with the provisions of current legislation on the protection of personal data, the parties involved are informed that their data will be processed, the basis of such processing being the correct execution of this agreement.

The data will be kept for as long as the agreement is in force and, in any case, in compliance with the applicable legal limitation periods.

No data will be transferred to third parties, unless legally required or technically necessary, nor are international transfers of such data planned, which, if carried out, will be done with all the guarantees.

The Client may exercise their rights of access, rectification, deletion, portability and limitation or opposition by sending an e-mail to: reservas@cincariders.com.

The Client has the right to complain to the Control Authority (Spanish Data Protection Agency: www.aepd.es).

17.- Modification of General Conditions

Cinca Riders, S.C. reserves the right to modify these General Conditions. In the event of any modification affecting the essential conditions of the Contract, Cinca Riders, S.C. must give prior notice to the Client within a reasonable period of time.

18.- Early termination

Cinca Riders, S.C. reserves the right to terminate the service in the event of non-compliance by the Client with his obligations under the said contract and, in particular, in the event of a false declaration concerning the identity of the Client, in the event of failure to return the product and accessories on the agreed date, non-payment of the rental or repairs, fines for delay or the amount of the rental still owed in the event of theft, serious and repeated failure to comply with the instructions for use of the product, which may be detrimental to the integrity or safety of the product or third parties, or to the good image of the service, the subletting of the product by the Customer, failure by the Customer to comply with the intellectual property rights of Cinca Riders, S. C. by the Client and the use of the product within the framework of a professional activity.

20.- Jurisdiction

Any controversy that may arise between the parties as a result of the contract shall be subject to the jurisdiction of the Courts and Tribunals of Barbastro, and both parties waive any other jurisdiction that may correspond to them by reason of their own.
